1. Scope of Application
1.1 These General Terms and Conditions (GTC) apply to all agreements concerning the use of pitches and services provided by Duemo Camperpark Aguilas (hereinafter referred to as the “Campsite”) and its guests (hereinafter referred to as the “Guest”).
1.2 By making a reservation or using the services of the Campsite, the Guest accepts these GTC.
1.3 Any terms and conditions of the Guest that conflict with or deviate from these GTC shall not be recognized unless the Campsite has expressly agreed to their validity in writing.
2. Conclusion of Contract and Reservations
2.1 The presentation of pitches, rental accommodations, and other services on the website, in brochures, or similar materials does not constitute a binding offer by the Campsite.
2.2 Reservations may be made verbally, by telephone, in writing, or by email. By making a reservation, the Guest submits a binding offer to enter into a contract.
2.3 The contract is concluded upon the Campsite’s written or electronic reservation confirmation being sent to the Guest.
2.4 Special requests made by the Guest shall only be binding if confirmed in writing by the Campsite.
3. Prices and Payment Terms
3.1 The prices applicable are those valid at the time of the stay. These may differ from the prices in effect at the time of reservation due to price adjustments.
3.2 All prices are stated in Euros and include the applicable statutory Value Added Tax (VAT).
4. Arrival and Departure
4.1 Unless otherwise agreed, reserved pitches are available from 12:00 noon on the day of arrival and must be vacated by 12:00 noon on the day of departure.
4.2 In the event of a late arrival, the Guest must inform the Campsite in good time. Otherwise, the Campsite reserves the right to allocate the pitch or accommodation to another guest.
4.3 No refund shall be granted in the event of early departure.
5. Cancellation Policy
5.1 Any cancellation or modification of a stay must always be made in writing.
5.2 Unless otherwise agreed, a deposit of €50.00 is required when booking a pitch. The reservation becomes binding only upon receipt of this deposit.
If written notice of cancellation is received no later than 30 days before the planned arrival date, the deposit will be credited as a voucher for a future stay at the Campsite. This credit has no expiration date and may be applied to a new reservation. Refunds are excluded; alternatively, the deposit may be retained as an administrative fee.
If the cancellation is made less than 30 days before the arrival date, the deposit will be forfeited.
6. Obligations of the Guest
6.1 The Guest is obliged to treat the assigned pitch or rental accommodation, as well as the communal facilities of the Campsite, with due care and to comply with the Campsite regulations displayed at reception.
6.2 The Guest must register themselves and their accompanying persons upon arrival and check out upon departure.
6.3 The Guest is responsible for any damage caused by themselves or their visitors.
6.4 Tents, caravans, motorhomes, or similar equipment may only be set up on the assigned pitches.
6.5 Open fires are generally prohibited on the Campsite unless designated and approved fire areas are provided. Barbecues are permitted only with suitable equipment and in compliance with safety regulations.
6.6 Waste may only be disposed of in the designated containers. Waste separation and recycling regulations must be observed.
6.7 Quiet hours must be observed from 11:00 p.m. to 8:00 a.m. Excessive noise that may disturb other guests must be avoided.
6.8 Pets are generally allowed on the Campsite but must be declared in advance. The Guest is responsible for the behavior of their pet and must ensure that other guests are not disturbed. Pets must be kept on a leash throughout the Campsite.
6.9 The use of sanitary facilities is at the user’s own risk. Parents or legal guardians are responsible for their children.
Liability of the Campsite
7.1 The Campsite shall not be liable for damages caused by force majeure or other circumstances beyond its control (e.g., natural events, power outages, strikes).
7.2 The Campsite accepts no liability for valuables left by the Guest on the premises or in rental accommodations.
7.3 Participation in leisure activities and use of the Campsite facilities are at the Guest’s own risk.
8. Data Protection
The collection, processing, and use of the Guest’s personal data shall be carried out in accordance with applicable data protection laws. The Campsite’s Privacy Policy is available on its website.
9. Final Provisions
9.1 Should any provision of these GTC be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the original provision.
9.2 The Campsite reserves the right to amend these GTC at any time. The current version is available on the Campsite’s website.
